Device means an electronic device through which the User accesses the Website
User means a person visiting a Shop Site in order to learn about the Administrator's offer or filling in a contact form
Dataset means a set of data of personal nature collected by the Data Controller.
§ 1 GENERAL PROVISIONS
- In this document, the User shall obtain information on the general principles of data processing in the Administrator's organisation, information on the Administrator (as defined in Article 13 of the PDPA), storing information or gaining access to information already stored in the User's telecommunication terminal equipment by means of cookies or web storage technology, used in connection with the User's visit to the Shop Site, including browsing, reading by the User the content of the Shop Site, placing an order or filling in the contact form available on the Site.
- Users' personal data are processed in accordance with the RODO, the Act of 10 May 2018. on the protection of personal data (i.e. Journal of Laws of 2019, item 1781) and other regulations relating to the processing of personal data of the Users of the Shop Site.
- The Data Controller shall exercise due diligence in the processing of Users' personal data. In particular, he/she applies appropriate technical and organisational and organisational measures aimed at ensuring the protection of processed personal data. Moreover, the access to the processed data is granted only to authorized persons and entities acting on his/her explicit instructions.
§ 2 INFORMATION CLAUSE
- The Administrator of Users' personal data is Roman Wiszniewski, conducting business under the name Wiszniewski Roman Przedsiębiorstwo Handlowo Usługowe Matterhorn in Namysłow at Wiejska 5 Street (46-100 Namysłow), holding NIP: 7521090831 and REGON: 531231850.
- Users' personal data will be processed for the purposes of:
- proper display of the Store Page and messages appearing to Users and administration of the Store Page (Article 6(1)(f) RODO);
- the performance of developer agreements within the scope of the Terms and Conditions (art. 6 par.1 b RODO);
- provision of services by electronic means to the extent resulting from the Terms and Conditions (art. 6.1 a RODO);
- fulfilment of the Orders (art. 6.1 b RODO);
- fulfilment of the Administrator's legal obligations (Art. 6(1)(c) RODO);
- fulfilment of the Administrator's legitimate interests, such as, but not limited to, direct marketing, verification of the quality of the Goods sold, analysis of activity on the Shop Site, investigation and defence against claims (art. 6(1)(f) RODO);
- The Administrator of the Users' personal data, in the performance of the purposes referred to above, may make the personal data available to entities providing consultancy or auditing services, a web host, an e-commerce software provider, an accounting service, entities providing advertising or marketing services, couriers and other entities, if it deems it reasonable and proportionate in relation to the purposes indicated above. The Users'/Customers' personal data may also be made available to entities entitled to receive them under generally applicable laws, including in particular judicial authorities.
- Users' personal data will not be stored indefinitely, but only until:
- withdrawal of consent - with regard to data whose basis for processing is the User's consent;
- achievement of the purpose of processing - with regard to personal data whose processing is necessary for the performance of the developer agreement or to take action at the request of the User, prior to the conclusion of the agreement;
- the effective lodging of an objection, the achievement of the purpose of processing, or the cessation of the legitimate interest of the Data Controller - with regard to personal data processed on the basis of the legitimate interest of the Data Controller;
- becoming obsolete or no longer relevant - with regard to data processed in order to answer a question sent by the User using the contact form;
- expiry of the legitimate interest of the Data Controller - with regard to data processed on the basis of the legitimate interest of the Data Controller.
- The Data Controller shall not process any special categories of personal data.
- Users have the right to request from the Data Controller access to their personal data, rectification, erasure or restriction of processing, the right to object to processing, as well as the right to data portability and the right to declare the withdrawal of any consent given at any time. The withdrawal of consent shall not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal.
- The provision of data by Users is voluntary, but necessary in order to use the functionalities of the Shop Site, to communicate between the Data Controller and the User, to conclude agreements, to undertake and carry out Orders and to provide other services by the Data Controller.
- Users' Internet identifiers may be transferred outside the European Economic Area.
- The Users' personal data will not be processed by automated means.
- Users have the right to lodge a complaint to the supervisory authority (President of the Office for the Protection of Personal Data).
§ 3 COOKIES
- The Data Controller stores server logs, such logs are created automatically. The Internet browser used by the User automatically transmits to the Data Controller data concerning the browser version, time of access and the amount of data, IP address, which data is used to improve the operation of the Shop's website, to verify the operation of servers, as well as for statistical purposes.
- Cookies are small pieces of text sent by the Store Page to the User's browser, stored in the device's memory and sent to the Store Page each time the User visits the Store Page.
- During your use of the Store Page, text files (‘Cookies’) may be stored. The Cookies used by the Data Controller are safe for the User's Device. They are designed to display the Store Page according to the User's preferences. Cookies allow the software used by the User to be identified. Cookies usually contain the name of the domain from which they originate, the time they are stored on the Device and the assigned value.
- The Data Controller uses two types of cookies:
- Session cookies: they remain on the User's Device until the User leaves the Shop Site or switches off the Internet browser, after which time they are permanently deleted from the device;
- Persistent cookies: they are stored on the User's Device for the time specified in the given Cookie, or until they are deleted by the User.
- The Data Controller may use own Cookies (placed by the Data Controller) and external Cookies (placed by external entities).
- In addition to Cookies, the Data Controller may also use other similar technologies, including web storage technology. Web storage technology, consisting of local storage and session storage, is similar to Cookies, with the difference that the browser does not send them each time to the Shop Site. Both cookies and web storage variables can be deleted when the User's browser is closed (session cookies and session storage variables) or stored longer (persistent cookies and local storage variables). The technologies described above are commonly used to enable the operation and improve the performance of the websites and to collect data about the behavior of their Users. Information on the technologies used is available to the User in the information on the cookies used displayed on the website during the User's first visit and available on an ongoing basis during browsing. In the event of any objections, the User may contact the Data Controller.
- The first time the User accesses the Shop Site, information on the use of cookies is displayed. If the User immediately decides to accept the use of Cookies in full, he/she should click ‘I agree’ - this means that the User consents to the use of Cookies of all categories that are used. To find out more and to further manage the consents given, the User has the option to click on the ‘Preferences’ button and then to express or refuse consent to the use of first-party Cookies of individual categories or by selecting preferences for the content embedded on the website, including third-party services, and to click on the ‘Confirm selection’ button. Once you have ‘Consented’ and/or ‘Confirmed your choice’ regarding the use of Cookies, information on their use is available at all times on the Shop Site under the ‘Cookies’ button available at the bottom of the Shop Site. - Within the preferences for consenting to the use of Cookies of each category, the following can be distinguished:
- necessary - they are necessary for the proper functioning of the Shop Site therefore they cannot be disabled from this level, the use of these cookies does not involve the processing of personal data. It is possible to switch them off in the browser settings, which may, however, disrupt the proper operation of the Shop's Website;
- analytical - are aimed in particular at gaining the Administrator's knowledge of statistics on site traffic and the source of visits. Usually the collection of this data is done anonymously;
- marketing - their purpose is to track user traffic on the Internet and to display advertisements that may be of interest to specific Users. Cookies may originate from third parties and be used by these entities to create a profile of the User's preferences. Their operation is subject to the User's consent;
- Other - Cookies that cannot be assigned to the above categories.
- Most web browsers allow by default the placement of Cookies and web storage variables and similar technologies on the User's Device. You may configure your browser not to do so, although doing so maylimit the functionality of the Store Site.
